The Uttar Pradesh government has defended Vikas Dubey’s encounter in the Supreme Court, saying the Kanpur gangster was asked to surrender but he refused and fired at the police.
In its affidavit in the Vikas Dubey encounter case, the government has said that the vehicle, which was ferrying the gangster to Kanpur from Ujjain, overturned due to rain and speed.
The UP government said, “Police personnel in the vehicle got seriously injured. Vikas Dubey took the pistol from one of the injured personnel.” The affidavit mentions that Vikas Dubey was asked to surrender but refused to do so and fired at the police.
“The only option available to the escort party, under the circumstances was to fire back in self defence,” the affidavit read, adding an inquiry commission has already been set up.
Vikas Dubey was killed in an encounter on the morning of July 10 when a police vehicle carrying him from Ujjain to Kanpur met with an accident and he tried to escape from the spot in Bhauti area, the police have claimed.
The UP government also said, in its affidavit, that the facts in the Hyderabad encounter case were different from the Vikas Dubey encounter case.
The Supreme Court is likely to pronounce a judgment on Monday.
