This is what NIA’s Bhima Koregaon chargesheet says about Stan Swamy

There has been a huge uproar since the arrest of 83-year-old priest and tribal activist Stan Swamy by the National Investigation Agency (NIA). But in the 10,000-page NIA chargesheet in Bhima Koregaon case, Swamy has emerged as the central character, who is allegedly hand in glove with the CPI-Maoist, a banned outfit in India.

The NIA chargesheet says Stan Swamy planned to prepare a front to take on the Modi government through the means of armed militia. Swamy is a Jharkhand-based Jesuit priest. He has been booked for criminal conspiracy under the Unlawful (Activities) Prevention Act (UAPA).

The NIA says Swamy conspired to bring together Dalit and Muslim forces to take on what he referred to as the “fascist government” at the Centre. The NIA, in its chargesheet, has referred to a letter written by Stan Swamy.

In his letter, Stan Swamy allegedly says, “An all-India front will not be effective. It shouldn’t just be used for propaganda against fascist forces on the ground level as it unleashed a major blitzkrieg of offensive campaigns against fascist forces. The front has to come up at village level, small town and cities, neighbourhood level in urban areas with militant sections of people being organised.”

“In order to develop the process…from very beginning we should bring together most Dalit and Muslim forces that are already taking shape in some parts of country. For example, such Dalit forces are taking shape in South, Tamil Nadu and Gujarat, and Muslim minority forces in Kerala, Karnataka and Maharashtra.”

Swamy has, the NIA says, referred to “armed attacks on Dalit and religious minority people by the organised Hindutva” to build his case. “They want to take training by going into revolutionary armed struggle areas,” he allegedly says in the letter.

The NIA chargesheet says Stan Swamy was in communication with CPI-Maoist cadre Comrade Arun. He communicated that after the arrest of urban CPI-Maoist cadres from different parts of the country, particularly Maharashtra, a huge irrevocable damage has been caused to the party.

The NIA chargesheet records Stan Swamy as saying that directives issued from time to time from the party are not followed in proper manner due to which heavy damage has been caused to the party and in future we need to avoid any such mistakes.

The NIA says it has recorded communication made to Stan Swamy asking him to submit a report on the progress of work assigned to him in time for future planning.

WHAT ELSE NIA CHARGESHEET SAYS

1) The NIA chargesheet says its probe has revealed that Stan Swamy received Rs 8 lakh through one Comrade Mohan for furtherance of the CPI-Maoist activities. He is the convener of Persecuted Prisoners Solidarity Committee (PPSC) frontal organisation of the CPI-Maoists.

2) The majority of seizures from his place are the documents related to communication for furthering the activities of CPI Maoist including press releases and propaganda material, the NIA chargesheet says.

3) The documents recovered from Stan Swamy are related to the literature of 50 years of Naxalbari, CPI-Maoist press releases, circular issued by the central committee (CC), literature on how to smuggle things (sneak it through smuggling made easier), letter to Stan Swamy from one Prashant, letter to Vijayan Dada from Stan Swamy regarding mobilising of Adivasi and regarding concerns raised by CC, guide of encrypted data communication on GSM network, message on the celebration of the 13th anniversary of CPI-Maoist, an essential underground handbook, letter between comrades for using encryption, mini-manual of urban guerilla, the Constitution of CPI-Maoist, documents related to the status of PLGA in excel sheet, document on strategy and tactics of Indian revolution.

4) Documents recovered during searches at Surendra Gadling on April 17, 2018 also indicate the role of Stan Swamy being discussed between letters from Comrade Sudha to Comrade Prakash.

5) In one of the letters seized from Swamy it is stated: “On the technical side the new CPI-Maoist general secretary has issued specific instructions regarding maintaining security of the communication channel. All open members who are required to contact secret members either from MO or interior must use – – – encryption.”

6) “Rise-up by default allows this feature but to get started you first need to create your own public/ private key pair. For non-tech savvy comrades there is a very easy way to use – – – – extension—, which can be set up within minutes. It provides full E2E (Encryption to Encryption) encryption for textual messages via…. Any attachments sent with email must be encrypted using…. of the receiver. For our communication I have sent you my pub.key…. This should only be used for bilateral channel.”

7. The conspirators, the NIA says, were worried that their communication would be leaked or recovered by agency. “Many critical problems have surfaced in the last one year some of them are extremely worrisome. The most urgent one is leakage of several secret letters including those meant only for senior leaders both outside and inside. It is unclear how so. Many of them were exposed from Delhi.”

8) “One possibility is the deleted letters may have been forensically recovered using specialised softwares. We should enhance our knowledge of forensic data recovery in order to prevent further mistakes,” the NIA says recording the concerns of the group.

9) “Such grave mistakes come with heavy costs in terms of exposure of secret channels and our open comrades who operate these channels leading to their prolonged incarceration and adding to the existing damaging losses faced by party especially in Maharashtra and AP/Telangana.”

10) “In Telangana, Srinivas was given the responsibility to ensure political protection for VV (reference Vara Vara Rao), though he contributed significantly in providing internal MHA strategy being used in enemy operations against us, he failed to lead negotiations to VV’s freedom or at least regular bail. Now it has led to cascading losses on several fronts. Without VV there is no leader of equal experience who could guide the MOs and the people’s war in a coordinated fashion. The CC fears that all this will lead to further splits and diversion among leading comrades, especially those working on all India levels. If we don’t take immediate measures the new comrades who wish to join the party may become skeptical of our sincerity and ability to fight the fascist political powers in India.”

11) The NIA says Stan Swamy even worries about several key arrests of “urban naxals.” “The arrest of several comrades in Maharashtra and Delhi has severely crippled our legal defence group too, because some of these comrades were coordinating defense of political prisoners on all India level. Now the ones left are not experienced enough to correctly understand and counter the shrewd multifaceted strategy employed by the enemy. State police have become a chronic pain for us by continuously disrupting our activities both on urban and interior operations.”

12) The letter has also instructed that all SC leaders to work with “the principle of no rest, no negligence and no mercy” and to do everything possible to “disrupt the fake development propaganda disseminated by star campaigners of BJP-RSS corporate friendly family”. “Our aim should be to stop them from making inroads into tribal masses and lower middle class population. “

13) On international front in the absence of Rona Wilson and Sai Baba, there has been major disruption in communicating with international Maoist parties. It said Sri Lanka and Nepal operations are also impacted. “Keeping all these necessities in view the Central committee has directed one comrade to assume the responsibility of international coordination of solidarity programmes and making arrangements for bilateral delegations. But please ensure both are sufficiently trained in order to understand sensitive aspects of technical security.”

14) A letter in Telugu dated July 2017 and addressed to Comrade Sunil from Sridhar is also mentioned where it is stated that Sudhir Dhatwalia be given responsibility about organisation of programme by the name of “Brahmanical Hindu Anti Fascist Front” for furtherance of CPI-Maoist agenda. It culminated into, the NIA chargesheet says, the formation of the front Bhima Koregaon Shaurya Din Prerana Abhiyan, which resulted into organisation of Elgar Parishad Programme on December 12, 2017 at Shaniwarawada in Pune.

15) There is also discussion about avoiding the name of the “anti-fascist” front as it would turn negative appeal to public. The NIA says there is a clear mention about giving such responsibility to accused Sudhir Dhawale along with monetary support is found mentioned in a letter from Com M (wanted accused Milind Teltumbde) to accused Ron Wilson.
