Delhi High Court shouldn’t have taken up Gautam Navlakha’s plea, says Supreme Court

New Delhi: The Supreme Court on Monday said that the Delhi High Court ought not to have dealt with activist Gautam Navlakha’s case and instead the Bombay High Court or the top court should have been approached, while setting aside a Delhi HC order seeking all the records of his sudden transfer to Mumbai in connection with a case instituted against him in the Bhima Koregaon incident.

The Delhi High Court had on May 28, 2020, taken a dim view of the NIA’s sudden decision to transfer Navlakha from Tihar jail to Mumbai ahead of a scheduled court hearing. It had also sought all the records relating to the NIA decision to shift him to Mumbai.

The NIA had objected to the tone and tenor of the HC ruling in the top court. Appearing for the NIA, Solicitor General Tushar Mehta said that the remarks of the HC against NIA the investigating agency were uncalled for.
